Terms of Service

These Terms of Service ("Terms") govern your use of https://morivervalleyloop.com (the "Site") and the services provided by the Missouri River Valley Loop ("the LOOP," "we," "us," or "our"). By using the Site, joining the LOOP, or purchasing a paid feature, you agree to these Terms. If you do not agree, do not use the Site or Services.

1. The LOOP and the Services

The LOOP is a regional tourism guide for the Missouri River Valley. The Services include a town and business directory, event listings, maps, and interactive experiences such as the LOOP passport and scavenger hunts. Some features (for example, business listings, promotions, or paid experiences) may require payment as described at the time you sign up for them (an "Order"). If an Order conflicts with these Terms, the Order controls for that feature.

2. Using the Site

  • The directory, event, and experience information is provided for general informational purposes.
  • Listings describe independent third-party businesses, events, and attractions. We do not operate those businesses or events and are not responsible for their hours, pricing, availability, or conduct. Confirm details directly with the business or organizer before relying on them.
  • Use the Site lawfully and do not attempt to disrupt, scrape, or misuse it.

3. Business listings and "Join the LOOP"

  • If you submit a business to the LOOP, you confirm you are authorized to represent that business and that the information you provide is accurate.
  • Any listing, promotion, or participation fees are described when you sign up. [Confirm paid listing terms and fees before launch.]
  • Business accounts cannot upload photos or other images through the LOOP admin. Any photography shown for a town or listing is added by the LOOP.
  • We may edit, decline, or remove listings that are inaccurate, unlawful, or inconsistent with the purpose of the LOOP.

4. Experiences, passports, and scavenger hunts

  • Interactive experiences are offered for enjoyment and may change or end at any time.
  • Rewards, prizes, or incentives are subject to availability and any rules stated for that experience, and may be provided by participating businesses rather than the LOOP.
  • Some experiences are free and some require payment, as stated for each experience at sign-up.
  • Photos submitted by passport participants are used only to verify scavenger-hunt activity (for example, confirming a checkpoint visit) and for nothing else. They are not published, used in promotion, or shared for marketing.

5. Payments and fees

  • Paid features are processed by Stripe. By paying, you agree to Stripe's terms and authorize the charge. The LOOP does not store your card number or other card details.
  • Fees are due as set out in the applicable Order. [Confirm fees and any recurring terms for paid listings and experiences before launch.]
  • Refunds and cancellations are governed by our Refund Policy.
  • Late or failed payments may pause a paid feature and may incur a fee to the extent permitted by law.

6. SMS communications

  • By opting in to SMS, you agree to receive text messages about the LOOP services you have requested — for example passport and scavenger-hunt updates, verification codes, business listing notifications, and support responses. These messages are sent by Wild Kahuna, our technology partner, on our behalf.
  • Consent to receive SMS messages is not a condition of purchasing any product or service.
  • Message frequency varies with the services you use, and message and data rates may apply.
  • Reply STOP to any message to opt out at any time, or reply HELP (or use our contact page) for assistance.
  • Wireless carriers are not liable for delayed or undelivered messages.
  • SMS opt-in consent is not sold or shared with third parties or affiliates for their marketing purposes; see our Privacy Policy and SMS Terms.

7. Your responsibilities

  • Provide accurate information for any submission, sign-up, or payment.
  • Hold the necessary rights to any content, logos, photos, or materials you provide to the LOOP, and grant us a license to use them to operate and promote the directory and the Services.
  • Do not infringe others' rights or use the Site to post unlawful or misleading content.

8. Intellectual property

  • The "Missouri River Valley Loop" name, branding, site design, and original content are owned by the

Missouri River Valley Loop and may not be used without permission.

  • Your content (such as business information you submit) remains yours; you grant us a license to display and use it in the directory and related promotion. Photos submitted through the passport are used only for scavenger-hunt verification as described above and are not used in the directory or promotion.
  • Business names, logos, and event information remain the property of their respective owners.

9. Third-party services

The Services rely on third-party providers (for example, Stripe, Google Maps, Google Analytics, hosting, and email) and link to independent businesses and events. Your use of those services is subject to their terms, and we are not responsible for their acts, omissions, or availability.

10. Disclaimers

The Site and Services are provided "as is" and "as available." To the fullest extent permitted by law, the LOOP disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that directory, event, or experience information is accurate, complete, or current, or that the Site will be uninterrupted, error-free, or secure.

11. Limitation of liability

To the fullest extent permitted by law, the LOOP will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Site, the directory, or any experience. Our total liability for any claim will not exceed the amount you paid to the LOOP (if any) for the feature giving rise to the claim in the 12 months before the claim.

12. Indemnification

You agree to indemnify and hold the LOOP harmless from claims, losses, and expenses arising from your content, your use of the Services, or your violation of these Terms or applicable law.

13. Termination

We may suspend or end your access to a paid feature or the Site for violation of these Terms or for conduct that harms the LOOP, other users, or listed businesses. You remain responsible for fees for features already provided.

14. Governing law and disputes

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-laws rules. The parties agree to the exclusive jurisdiction of the state and federal courts located in Missouri, unless an Order specifies another venue.

15. Changes to these Terms

We may update these Terms by posting a revised version with a new "Last updated" date. Continued use of the Site or Services after changes means you accept the revised Terms.
